CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION & RETURN CONDITIONS

GENERAL CONDITIONS:

  • By placing an order electronically on our website, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

  • Buyers are subject to the provisions of the Law on Consumer Protection No. 6502 and the Distance Sales Regulation (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of purchased products.

  • The shipping cost for product delivery is paid by the buyer.

  • Each purchased product is delivered to the recipient or the designated person/entity at the provided address within the legal period of 30 days. If the product is not delivered within this period, the buyer may terminate the contract.

  • The purchased product must be delivered complete, in accordance with the specified features in the order, and with all related documents, such as a warranty certificate and user manual, if applicable.

  • If the sale of the purchased product becomes impossible, the seller must inform the buyer in writing within 3 days of becoming aware of the situation. The total amount must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  • If the buyer does not pay for the purchased product or if the payment is canceled in bank records, the seller is relieved of the obligation to deliver the product.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

  • If, after the product has been delivered, it is determined that the credit card used for payment was fraudulently or unlawfully used by unauthorized persons and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED DUE TO UNFORESEEN CIRCUMSTANCES:

  • If unforeseen circumstances arise that prevent the seller from delivering the product within the required time, the buyer is informed of the situation. The buyer may choose to cancel the order, replace the product with a similar one, or postpone the delivery until the obstacle is resolved. If the buyer cancels the order:

    • If the payment was made in cash, the refund is processed within 14 days.

    • If the payment was made by credit card and canceled, the refund is processed within 14 days; however, the bank may take 2-3 weeks to transfer the funds to the buyer’s account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  • Before accepting the delivery, the buyer must inspect the product for damage such as dents, breakages, or torn packaging and must not accept delivery if any issues are found. Any product received is considered undamaged and intact.

  • The buyer must take care of the product after receiving it. If the right of withdrawal is to be exercised, the product must not be used. The invoice must also be returned along with the product.

RIGHT OF WITHDRAWAL:

  • The buyer may withdraw from the contract within 14 days from the date of product delivery to themselves or a designated person/entity, without any legal or criminal liability and without providing a reason, by notifying the seller through the contact details below.

DURATION OF THE RIGHT OF WITHDRAWAL:

  • If the purchase is for a service, the 14-day period starts from the date the contract is signed. If the performance of the service begins with the consumer's approval before the withdrawal period ends, the right of withdrawal cannot be exercised.

  • The costs arising from the exercise of the right of withdrawal are borne by the seller.

  • To use the right of withdrawal, the buyer must send a written notification to the seller via registered mail, fax, or email within the 14-day period, and the product must remain unused as specified in the "Products That Cannot Be Returned" section of this contract.

EXERCISING THE RIGHT OF WITHDRAWAL:

  • The invoice for the returned product must be sent. (If the returned product was purchased by a business entity, the return must include the original invoice issued by the company. If a refund invoice is not provided, the return process cannot be completed.)

  • The return form must be completed.

  • The product must be returned complete, with its box, packaging, and all standard accessories, without any damage.

RETURN CONDITIONS:

  • The seller must refund the total amount and return all legally binding documents to the buyer within 10 days of receiving the withdrawal notice. The product must be returned within 20 days.

  • If the value of the product has depreciated due to the buyer’s fault or if the return becomes impossible, the buyer must compensate the seller for the loss in proportion to their fault. However, if the product is used properly and any changes or deterioration occur within the withdrawal period, the buyer is not responsible for these changes.

  • If the buyer’s withdrawal reduces the order total below the promotional campaign limit, the discount obtained under the campaign is canceled.

PRODUCTS THAT CANNOT BE RETURNED UNDER THE RIGHT OF WITHDRAWAL:

  • Products prepared according to the buyer's request or explicitly tailored to their personal needs, and products that cannot be returned due to their nature, including:

    • Underwear, swimsuits, bikini bottoms, cosmetic products, single-use items, perishable goods, or products with a risk of expiry

    • Products that cannot be returned for health or hygiene reasons if their packaging has been opened after delivery

    • Products that have been mixed with other items after delivery and cannot be separated due to their nature

    • Newspapers, magazines, and other periodicals except for those provided under a subscription agreement

    • Digital content services provided instantly

    • Software, data storage devices, computer consumables, DVDs, CDs, and books that have been opened by the buyer cannot be returned as per regulations.

  • Additionally, if the provision of a service has begun with the consumer's approval before the withdrawal period expires, the right of withdrawal cannot be exercised for such services.

  • For cosmetics, personal care products, underwear, books, downloadable software, DVDs, VCDs, CDs, cassettes, and stationery (toner, cartridges, ribbons, etc.), returns can only be accepted if the packaging is unopened, untested, undamaged, and unused.

DEFAULT AND LEGAL CONSEQUENCES:

  • If the buyer defaults on a payment made by credit card, they agree to pay interest and accept liability towards the bank in accordance with their credit card agreement.

  • In this case, the relevant bank may take legal action and demand any costs and attorney fees from the buyer.

  • If the buyer defaults on their debt, they agree to compensate the seller for any losses and damages resulting from the delayed payment.

PAYMENT AND DELIVERY:

  • Payments can be made via credit or debit cards through our website.

  • You can choose to pay in full or in installments using various credit card options.

  • Online payments will be processed, and the transaction amount will be deducted from your credit card at the time of purchase.
